OVERVIEW:

ESQ Recruiting is representing a leading and fast growing publicly traded Global Medical Device Company. The VP & Regional Chief Compliance Officer, RNCA will be part of a global compliance team and provide strategic leadership and oversight of all compliance-related activities across the Company's departments and programs in the Region of North America (RNCA – U.S., Canada, Latin America, and the Caribbean). Will direct and manage all aspects of Compliance in the Region of North America, and provide independent oversight and coordination of the corporate-wide compliance program, promoting a culture of compliance and the highest standards of ethics, integrity, and responsibility. The VP & Regional Chief Compliance Officer, RNCA will report directly to the Senior Vice President Chief Compliance and Integrity Officer, who reports directly to the CEO and is a member of the Company Executive Management Team.

ROLE SUMMARY/PURPOSE:

Primarily be responsible for creating, implementing and maintaining the compliance program for Company's North American Region (RNCA – U.S., Canada, Latin America, & Caribbean) in alignment with the overarching global compliance strategy Providing guidance to North America’s business and senior management team on all compliance-related matters. Working with senior management and legal counsel to determine risks and action plans. Creating and implementing policies and procedures to ensure consistency across the Company’s RNA business. Be a member of the Global Compliance Leadership Team as well as a member of the Regional Management team for RNCA.

RESPONSIBILITIES & KEY TASKS

  • As full member of the Global Compliance Leadership Team, contribute to the further development of the Global Compliance programs and role of Compliance in the Company.
  • Establish compliance standards in accordance with the Company’s Global compliance strategies and priorities, and applicable laws, regulations, and industry codes, where applicable for the Region and countries.
  • Oversight of compliance programs and activities for the Region to ensure alignment with strategic priorities and business goals.
  • Develop, initiate, maintain, and revise standards for the general operation of the compliance program and its related activities to prevent illegal, unethical, or improper conduct in the Region.
  • Advise and consult on transactional matters, emerging risk areas, areas of policy or procedural gaps or ambiguity, or areas of increased enforcement attention.
  • Conduct periodic risk assessments regarding Compliance areas in the Region and participate in the Global Compliance Leadership’s Teams’ development of a yearly risk map for the entire Company.
  • Monitor the performance of the compliance program and reviews on a continuing basis, taking appropriate steps to improve its effectiveness.
  • Provide reports on a regular basis, and as directed or requested, to keep the SVP Chief Compliance & Integrity Officer and executive leadership informed of the operation and progress of compliance efforts.
  • Conduct investigations of alleged violations of compliance policy in the Region to ensure that compliance issues/concerns within the Company are being appropriately evaluated, investigated and resolved.
  • Ensure proper reporting of violations or potential violations to authorized enforcement agencies in the Region as appropriate and/or required.
  • In alignment with the Global Overarching Compliance Program set by the Global Compliance Leadership Team, develop, coordinate, deliver, and maintain an annual regional training plan for the compliance program (e.g. Code of Conduct, Anti-Bribery, etc.) and ensure on-boarding and annual refreshers are conducted.
  • Partner with legal counsel and other members of senior management as necessary to resolve difficult legal compliance issues.
  • Work closely with independent auditors and external exam teams to provide necessary support and materials necessary to test compliance programs and activities.
  • Maintain current knowledge of laws and regulations in the Region, keeping abreast of changes as they take place.
  • Monitor, and as necessary, coordinates compliance activities of other departments to remain abreast of the status of all compliance activities and to identify trends.
  • Conduct business travel within the RNCA region and elsewhere, as necessary
  • Potential for the right candidate to cover entire Americas (e.g. incl. South America as well).

QUALIFICATIONS & PERSONAL ATTRIBUTES:

  • MBA or JD highly preferred. Minimum Bachelor's degree required.
  • Minimum of 8years of experience and/or exposure to compliance mattersand supporting a business as a commercial in-house attorney Preference for Compliance Professionals from: Med Device, Pharma & Biotech companies, but will also consider consulting firm and law firm candidates with extensive life sciences client experiences, as well as compliance professionals from other industries seeking to transition to the medical device industry.
  • Experience in the design and implementation of compliance focused management information reports and the design and collection of compliance metrics.
  • Expertise in global regulatory regimes and requirements with specific knowledge of the U.S. regulations and regulatory expectations.
  • Experience with design, strategy and driving of a global compliance program.
  • Experience counseling senior management, crafting creative solutions and integrating multiple business objectives.
  • Demonstrated experience in an influential leadership role, and able to work with people in such a manner as to build up high morale and obtain group commitments to goals and objectives.
  • Strong business acumen, intelligence and capacity. Thinks strategically and implements tactically
  • Knowledgeable of how decisions impact all aspects of the business. Approaches his/her work very collaboratively
  • Fluent verbal and written communication skills in Spanish or Portuguese considered a plus.
  • The ability to balance between the growth needs of the company and the stringent compliance requirements associated with the healthcare services delivered by the company while ensuring compliance with the Standards of Conduct and all applicable laws and regulations
  • Must possess very strong business judgment and the ability to understand and respond to business issues and needs.

ELIGIBILITY REQUIREMENTS:

  • Must be willing to comply with pre-employment screening, including but not limited to, drug testing, reference verification and background check.
  • Must be willing to travel within the RNCA region, South America and 4x/year to Europe.
  • Must be willing to work out of an office in Atlanta, GA.
